Copyright infringement

Under copyright law, creative expressions concretely expressed to the public through words, text, sound, color, etc. are considered works protected by copyright, and copyright is granted to the author from the moment of creation.

As an online service provider, POSTYPE is obligated under Article 103 of the Copyright Act to immediately suspend the reproduction/transmission of works that infringe others’ copyrights and to notify both the claimant and the reproducer/transmitter.

In the following cases, we will take action depending on the severity.

• When a work is copied as-is without the original author’s permission
• When all or part of a work whose original and author are clearly identifiable is reproduced or distributed without authorization
• When files such as novels, comics, movies, broadcasts, and sound sources are illegally shared, or methods of obtaining them illegally are shared
• When content includes inducing or selling illegal copying/program installation
• When copyrights, trademarks, design rights, or other rights of third parties are infringed without authorization
• When there is a possibility of violating other relevant laws and regulations

However, ① posts where the original work and author are widely known, ② lawful distribution channels are clear, and ③ unauthorized reproduction/distribution of the full work is clearly recognizable as copyright infringement will be subject to immediate sanctions under this policy.

Defamation and other rights infringement

Article 307 of the Criminal Act states that a person who defames another by openly alleging facts or false facts may be subject to criminal punishment.

Please note that spreading unverified rumors or malicious gossip, or posting false or exaggerated content, may infringe on the rights of others.

In the following cases, we will take action depending on the severity.

• When facts or false facts are alleged for the purpose of slandering individuals or groups, such as spreading false information or groundless rumors
• Cyber sexual violence
• Cyber stalking
• Disclosure of others’ personal information such as address, personal email address, personal phone number, or bank account information
• When there is a possibility of violating other relevant laws and regulations

Reporting posts that infringe copyright or other rights

If you discover a post that infringes copyright or other rights Rights Infringement Report Center to request that the post be temporarily restricted. The Rights Infringement Report Center serves to protect the rights of original authors and to safeguard the lawful creative activities of POSTYPE creators.

As a content marketplace platform, POSTYPE cannot make legal determinations regarding the illegality of posts that infringe copyright or other rights or whether any legal defenses apply.

However, when a user whose rights have been infringed files a report through the appropriate legal procedures, the relevant post will be temporarily unpublished for 30 days in accordance with applicable laws. Temporary unpublishing for 30 days upon receipt of a report is an interim measure prior to any settlement between the parties or legal determination. All procedures after the temporary measure period ends will follow the parties’ agreement or lawful cooperation requests, recommendations, and rulings from investigative, mediation, or judicial authorities.

Depending on the case, in addition to temporary measures, if actions such as Step 3 – permanent unpublishing of the post (reposting not allowed), Step 4 – channel suspension, or Step 5 – account ban are taken, then depending on the step applied, it may not be possible to repost the relevant post, continue operating the existing channel, or use POSTYPE under the same identity.
