Copyright infringement

Under copyright law, creative forms of expression that are concretely expressed to the public through words, letters, sounds, colors, and the like are considered works subject to copyright protection, and copyright arises for the author from the moment of creation.

As an online service provider, POSTYPE is obligated under Article 103 of the Copyright Act to immediately suspend the reproduction/transmission of works that infringe another party’s copyright and to notify both the claimant and the reproducer/transmitter.

In the following cases, we will take action depending on the severity.

• When a work is taken and used as-is without the original author’s permission
• When part or all of a work whose original work and original author are clearly identifiable is reproduced or distributed without permission
• When files such as novels, comics, movies, broadcasts, or audio are illegally shared, or when methods of illegally obtaining them are shared
• When content includes recommendations or sales of illegally copied programs or software
• When copyrights, trademarks, design rights, or other rights of others are infringed without authorization
• When there is a possibility of violating other applicable laws and regulations

However, ① posts where the original work and original author are widely known, ② the legitimate distribution channel is clear, and ③ unauthorized reproduction/distribution of the entire work makes copyright infringement clearly recognizable will be subject to immediate sanctions in accordance with this policy.

Defamation and other rights infringement

Under Article 307 of the Criminal Act, anyone who publicly states facts or false facts that damage another person’s reputation may be subject to criminal penalties.

Please note that spreading unverified rumors or malicious gossip, or posting false or exaggerated content, may infringe on the rights of others.

In the following cases, we will take action depending on the severity.

• When facts or false facts are stated for the purpose of slandering an individual or group, such as by spreading false information or rumors
• Cyber sexual harassment or abuse
• Cyber stalking
• Disclosure of another person’s personal information, such as address, personal email address, personal phone number, or bank account details
• When there is a possibility of violating other applicable laws and regulations

Reporting posts that infringe copyright or other rights

If you find posts that infringe copyright or other rights, you can request temporary action on the post through the Rights Infringement Report Center. The Rights Infringement Report Center serves as a channel to protect the rights of original creators and to safeguard the legitimate creative activities of POSTYPE creators.

As a content transaction intermediary platform, POSTYPE is not in a position to make legal determinations on the illegality of posts that infringe copyright or other rights or whether there are any legal justifications for them.

However, if a user whose rights have been infringed submits a report through the proper procedure, the post in question will have its publication temporarily canceled for 30 days in accordance with the relevant laws. The 30-day cancellation of publication following the report is an interim measure prior to any settlement between the parties or legal judgment. After the temporary measure period ends, all subsequent procedures will follow the parties’ settlement or the lawful cooperation requests, recommendations, and judgments of the relevant investigative, mediation, or judicial authorities.

Depending on the case, in addition to temporary measures, if actions such as Step 3 – permanent cancellation of post publication (re-publication not allowed), Step 4 – channel suspension, or Step 5 – account block are taken, then depending on the level of action, re-publication of the post, continued operation of the existing channel, or use of POSTYPE under the same name may be restricted.
